El Green Mall users have high expectations from El Green Mall Marketplace and from you as a seller. These include clear written communication, high-quality sustainable products, fast delivery, and impeccable communication in all matters related to the order. We want to support sellers in their efforts to provide the best possible service and have therefore established binding principles for all sellers on El Green Mall Marketplace. This ensures fair competition on the platform and guarantees good service to the customer. The following vendor policies are binding and mandatory for El Green Mall as well as for every vendor who registers on El Green Mall's portal for the purpose of selling products on El Green Mall Marketplace.
I. Product Shipping
Products must be shipped within the specified shipping time. If nothing is specified in the product description or order form, shipping must take place within 2 business days and, for on-demand sellers, within a maximum of two weeks after confirmation of receipt of payment. By default, the order confirmation and receipt are sent to the seller by email.
The shipment cannot be confirmed to El Green Mall and the buyer until it has been made. Each shipment must be accompanied by an invoice stating that payment was made through El Green Mall Marketplace.
All sellers should select and engage their own carriers for shipping, El Green Mall does not provide discounts for engaging individual carriers in this regard.
II. Product Availability
Products that are not available (not in stock) should not be offered on the El Green Mall platform, unless they are produced "on demand". In this case, the seller should clearly inform the "on demand option" in the product description. If an item is no longer available after an order has been placed, El Green Mall Customer Service and the customer in question must be informed immediately.
For products that have not been shipped by the seller 4 business days after the payment by the buyer, El Green Mall automatically cancels the order on behalf of the seller. In this case, the seller will be charged the commission. For on-demand products, the maximum shipping time is 15 days.
After the package is shipped, the seller shall provide El Green Mall with a tracking number (on the El Green Mall seller portal) to be provided to the buyer. If the seller fails to do so, El Green Mall reserves the right to assume that the shipment has not taken place, with the associated legal consequences.
III. Product Price
In case that the seller is also offering the items in its own online or physical shop, such items must be set in the El Green Mall Marketplace at the same price or lower than the price offered in its own online or physical store, same applies to shipping cost. Unless a particular agreement stating otherwise is in place.
The Seller is also entitled to terminate the contract without notice upon receipt of a corresponding change in the commission.
V. Complaints and Queries
Complaints (reclamations) from buyers and inquiries from El Green Mall Customer Service must be answered immediately. If there is no response within 3 working days, the complaint may be decided in favor of the buyer.
VI. Items not delivered (arrived)
If a buyer states that they have not received the item, we require the seller to provide proper proof of receipt showing the recipient's address. If this is not provided within one week of the seller's receipt of the buyer's notice, the case may be decided in the buyer's favor. If the product is lost and the buyer does not receive it, El Green Mall is obliged to fully refund the buyer.
VII. Product Returns
In the event of a return, the buyer will be refunded the full amount after 5 business days from the date of the refund request. The product may be refunded within 30 days from the product purchase date. In the event of a return, the return shipping costs shall be covered by the buyer.
In the case of a return, the seller is obliged to notify El Green Mall of the receipt of the return by email.
VIII. Seller Absence
If the seller does not have access to El Green Mall platform for more than 3 working days (e.g. because of a holiday, temporarily closed, etc), all items on offer must be paused.
IX. Export-/Import Fees
If the seller is not a resident of the European Union (i.e. does not have a VAT number in the EU), the seller must pay all export and import fees. El Green Mall does not take any responsibility for any violations.
All products listed by the seller on El Green Mall Marketplace must include VAT. All taxes linked to the sale of the product are covered by the seller and not by El Green Mall unless an agreement stating otherwise is in place. The seller must consider, declare, and pay all the VAT applicable to where the buyer has made the purchase. El Green Mall does not take any responsibility for any violations.
X. Refund Period
The buyer has a refund period of 30 days starting from the date of purchase. This means that from the date of purchase the buyer has 30 days to return the product and guarantee an entire refund to their purchase amount. Only after the expiration of the refund period, if no refund request obliging El Green Mall has been made, the seller will receive the payment to their specified payment account configured in the El Green Mall vendor portal, unless an agreement stating otherwise is in place.
XI. Product Condition
Only new items may be offered on the El Green Mall marketplace. Used products might be posted in the El Green Mall marketplace only after review and written agreement by El Green Mall.
XII. Shipping of FSK-18 products, JuSchG
The seller is obliged to comply with the provisions of the German Youth Protection Act (JuSchG). Articles that are subject to the JuSchG may only be sent personally by registered mail to authorized persons. Examples of this are alcoholic products.
XIII. Merchant Names, URLs, Links
The seller name must not be in the form of a URL (*.de, *.com, etc.) and must not contain a URL. If you add covers or other images to the product description of an item, they must not contain any markings or lettering that are not directly related to the product. Images showing seller/shop names, logos or URLs may not be used for a product description on El Green Mall. The offer must not contain any links to external websites.
XIV. German / EU-Restrictions
The Seller is obliged to comply with the respective product regulations of the buyer's country. By posting their products on El Green Mall Marketplace, the seller confirms that they comply with all safety, legal and other regulations. El Green Mall does not bear any responsibility in case of violation.
XV. El Green Mall Seller Portal
All the seller's products, product descriptions and images are uploaded to the El Green Mall portal by the seller. All required seller information must be entered in the portal to start your sales. El Green Mall does not take any responsibility if information is entered incorrectly. It is the seller's responsibility to verify and make the corresponding changes if a correction is needed. If a claim is made against El Green mall because of information provided by the seller on the El Green Mall seller portal, the seller releases El Green Mall from all claims.
If a violation of this is detected by El Green Mall, El Green Mall is entitled to warn the seller in writing form (email is sufficient) and to impose a penalty of up to 5,000.00 € in case of a repeated violation of these dispositions.
XVI. Sustainability Verification Form & Green Score
On the Sustainability Verification Form, the seller should only select El Green Mall Sustainability Criteria that are true and accurate for the product sold by the seller.
El Green Mall uses a sustainability ranking (Green Score) based on multiple questions answered by the seller. Should El Green Mall be held liable for incorrect data provided by the seller, the seller will indemnify El Green Mall from any claims.
El Green Mall will issue a warning in written form (email is sufficient) to the seller if it detects a violation of the first paragraph of the current section and reserves the right to impose a contractual penalty of up to 5,000.00 €. The same applies if the seller provides false personal data.
In addition, El Green Mall reserves the right to remove products from the portal that receive negative customer evaluations regarding its sustainability, with a representative number of at least 10 reviews stating that they do not meet the sustainability criteria of El Green Mall. In this respect, the seller has no right to remain or re-post their product on El Green Mall.
In order to guarantee a correspondingly high quality of the offered products, El Green Mall carries out random quality checks every three months. El Green Mall will contact the sellers to request such products. Product costs and shipping for this purpose will be agreed on each particular case.
XVII. Product Pictures
Product images may not contain links, watermarks or similar branding. They must comply with the specific size and quality standards requested by El Green Mall.
XVIII. Third Party Rights
The seller is obliged to ensure that its products and the way they are presented do not infringe the rights of third parties.
XIX. Own Advertising
The seller is not allowed to use the personal data received through El Green Mall for further advertising. In particular, the seller is not allowed to add its own advertising to the shipment, send advertising emails to the customer or call or write to the customer for advertising purposes.
XX. Advertising for El Green Mall
The seller is obliged within reason to support El Green Mall in its marketing activities. El Green Mall may provide the seller with promotional material free of charge for this purpose. El Green Mall is also entitled to use any images of the seller for promotional purposes. This includes photos uploaded to the seller's social media accounts.
